Who this covers

Pacto provides ordering software to wholesalers. These terms cover you if you use the Order Pacto app, or order from a wholesaler by text message, WhatsApp or email through a number or address they gave you. Wholesalers themselves use the service under a separate agreement with Pacto.

The service is for businesses ordering from their suppliers. By using it you confirm you are acting for a business and are at least 16.

Your wholesaler is the seller

Pacto is the software. Every product, price, delivery and account term belongs to the wholesaler you order from, and the sale is a contract between you and them. Pacto does not set prices, hold stock, deliver, or take payment: nothing you do in the app or by message charges a card.

An order you place in the app is submitted to your wholesaler as you entered it. An order you send by message is read into a draft that your wholesaler reviews before it becomes an order; they may contact you if anything is unclear. Until they confirm it, nothing has been ordered.

Your account

Your wholesaler creates your login and can change or close it. Keep the password to the people at your business who place orders; anything ordered with it is treated as ordered by you. Tell your wholesaler at once if you think someone else has it.

Ordering by text message

The programme. Some wholesalers give you a number to text your orders to. Texting an order to that number is how you opt in; there is no other way to be enrolled, and we never text a number that has not texted us first. The invitation to text, with these disclosures, is at app.pactodistro.com/text-ordering.

What you receive. One automated reply per message you send, confirming it was received. Message frequency depends on how often you order. We send no scheduled, promotional or marketing texts.

Message and data rates may apply. Your mobile carrier may charge for texts you send and receive under your plan.

Opting out. Reply STOP to any message and you will receive no further texts from that number; you can still order through the app or by phone. Text the number again, or reply START, to opt back in.

Help. Reply HELP for assistance, contact your wholesaler, or email support@pactodistro.com.

Carriers. Mobile carriers are not liable for delayed or undelivered messages. A text that does not arrive is not an order, so if you get no acknowledgement, contact your wholesaler.

Your number. How it is stored and who sees it is in the privacy policy. It is not shared with third parties or affiliates for marketing purposes.

Ordering by WhatsApp or email

The same applies: sending an order is how you opt in, you get one acknowledgement per message, nothing is an order until your wholesaler confirms it, and the message and the number or address it came from are held as described in the privacy policy. Attachments are not read; put the order in the text of the message.

Availability

The service is provided as it is, and may be unavailable for maintenance or for reasons outside our control. If it is down, order from your wholesaler the way you did before. To the extent the law allows, Pacto is not liable for loss arising from an order that could not be placed or was delayed, and is in no case liable for the wholesaler’s performance of a sale.

Changes

If these terms change materially, the date at the top changes and the previous version is superseded. Continuing to use the service after that means you accept the new terms.
